Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://coveragent.ai, the CoverAgent AIwebsite, software, tools, content, and related services operated by Everest Wealth Builder LLC (Annapurna Insurance Solutions)("Company," "we," "us," or "our").

By accessing or using the Services, creating an account, submitting information through our forms, or otherwise interacting with the platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

• You must be at least 18 years old to use the Services.
• You must have the legal capacity to enter into a binding agreement.
• You are responsible for ensuring that your use of the Services is lawful in your jurisdiction.
• If you use the Services in connection with insurance solicitation, sales, recruiting, or contracting, you are responsible for obtaining and maintaining all required licenses, appointments, and registrations.

2. Description of Services

CoverAgent AI provides software, automation, website, communication, marketing, workflow, training, and related technology tools intended to support insurance agents, agencies, and related businesses. Features may include websites, lead capture forms, communication workflows, AI-enabled assistance, scheduling tools, content generation, CRM functionality, training materials, and integrations with third-party vendors.

CoverAgent AI is a technology platform. It is not an insurance carrier, insurer, broker-dealer, or legal advisor. Use of the platform does not by itself create any employment, agency, or producer relationship unless a separate written agreement expressly states otherwise.

We may add, remove, modify, suspend, or discontinue features at any time. Certain features may be limited by plan level, state availability, third-party terms, or legal restrictions.

3. No Insurance, Legal, Tax, or Investment Advice

• CoverAgent AI is a technology platform and does not itself underwrite insurance products.
• Content, prompts, AI-generated outputs, training materials, calculators, and workflows are provided for general informational and operational purposes only.
• Nothing in the Services constitutes legal, tax, accounting, compliance, investment, securities, or individualized insurance advice.
• You are solely responsible for reviewing all outputs, communications, illustrations, comparisons, marketing materials, and client-facing content before use.

4. Accounts and Security

• You must provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity occurring under your account.
• You must notify us promptly of any suspected unauthorized use.

5. Acceptable Use

You agree not to use the Services to:

• violate any law, regulation, carrier rule, or third-party right;
• submit false, deceptive, misleading, defamatory, or infringing content;
• send unlawful telemarketing, spam, or communications without required consent;
• misrepresent licensing status, product terms, carrier relationships, or expected results;
• upload malicious code or interfere with system integrity;
• use the Services in a way that creates consumer, regulatory, or carrier risk.

6. Compliance Responsibilities

You are solely responsible for your own compliance with all federal, state, and local laws, regulations, and carrier requirements applicable to your business, including licensing, advertising, disclosures, recordkeeping, privacy, TCPA, CAN-SPAM, and suitability requirements.

Use of any compliance-related tool, warning, disclaimer, template, or AI feature does not transfer legal responsibility from you to us.

7. Third-Party Services

The Services may integrate with or link to third-party vendors and platforms. Those services are subject to their own terms and privacy policies, and we are not responsible for their availability, changes, or data practices.

If you choose to pursue contracting, onboarding support, or carrier access through Everest Wealth Builder LLC (Annapurna Insurance Solutions) or a related entity, that relationship is separate from your basic use of the CoverAgent AI software and may be governed by additional disclosures, applications, or agreements.

8. Subscriptions, Free Trial, Auto-Renewal and Cancellation

Your paid subscription renews automatically and continues until you cancel. If you start a free trial, your payment card will be charged automatically when the 7-day trial ends (on day 8) unless you cancel before then.

Plans and prices

• Paid plans are billed monthly or annually, as you choose at checkout. The price of each plan, billing period, additional seat, and add-on is shown on our pricing page and at checkout before you subscribe.
• Your recurring charge is the price of your plan for the billing period you selected, plus any additional seats and add-ons you choose, plus applicable taxes. It is charged at the start of each billing period: every month for monthly billing, or every year for annual billing.
• Enterprise or custom plans purchased under a separate order form or invoice are governed by that agreement where it differs from this section.

Free trial

• Eligible first-time subscribers to a self-serve plan may start a 7-day free trial. A valid payment card is required to start the trial.
• You are not charged during the 7-day trial.
• Unless you cancel before the trial ends, your card is charged automatically on day 8 for the plan and billing period you selected at checkout, and your subscription then continues and renews as described below.
• Free trials are limited to one per person. We may decline a trial if you, your account, or your email address has already received one. Any additional trial terms are shown at signup.

Automatic renewal

• Your subscription renews automatically at the end of each monthly or annual billing period, and you authorize us, through our payment processor Stripe, to charge your payment method on file the then-current price for your plan, seats, and add-ons, plus applicable taxes, for each new billing period until you cancel.
• We may change prices prospectively. A price change applies to your subscription only from a renewal that occurs after we notify you of the change, and you may cancel before it takes effect.
• You are responsible for keeping your payment information current. If a payment fails, we may retry the charge and may suspend access to paid features until payment is received.

How to cancel

• You can cancel at any time online: go to Settings → Billing in your account, which opens the Stripe customer portal, and cancel your subscription there. If you need help, contact us at support@coveragent.ai.
• Cancellation takes effect at the end of your current paid billing period. You keep access until then, and you will not be charged again.
• If you cancel during a free trial, you will not be charged, and your access ends when the trial period ends.

Changing plans

• You can change your plan or billing period from Settings → Billing (the Stripe customer portal). Upgrades take effect immediately and are prorated for the remainder of your billing period. Downgrades take effect at the start of your next billing cycle.

Taxes

• You are responsible for any applicable taxes, government fees, or similar charges unless otherwise stated.

9. Refunds

• Free trial: nothing is charged during the 7-day trial. If you cancel before day 8, you are not charged.
• Monthly plans: you can cancel at any time and keep access until the end of the billing period. Monthly fees are non-refundable, including for partially used billing periods.
• Annual plans: annual plans are refundable within the first 30 days. After that, you can cancel and your access continues until the annual term ends; the remaining term is not refunded. To request a refund within the first 30 days, contact us at support@coveragent.ai.
• Nothing in this section limits any refund right you have under applicable law.

10. Suspension and Termination

• You may cancel your subscription as described in Section 8.
• We may suspend or terminate access if we believe you violated these Terms, created regulatory risk, failed to pay fees, or misused the Services.
• Termination does not relieve you of payment obligations already incurred.

11. Intellectual Property

• The Services, software, branding, copy, designs, and workflows are owned by us or our licensors.
• Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for your internal business purposes.
• You may not reproduce, redistribute, sublicense, or reverse engineer the Services except as permitted by law.

12. AI Features and Generated Content

AI features may produce incomplete, inaccurate, outdated, or inappropriate outputs. You are solely responsible for reviewing, editing, and approving any AI-generated text, script, marketing copy, client communication, recommendation, or summary before use.

13. No Guarantee of Results or Income

We do not guarantee leads, appointments, production, commissions, recruiting outcomes, business growth, or financial results. Testimonials, examples, and case studies reflect individual experiences and are not typical or guaranteed.

14. Communications Consent

By submitting forms or contact details through the Services, you agree that we may contact you about your inquiry, account, services, and related matters in accordance with your consent and our Privacy Policy. Message and data rates may apply.

15. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

16. Limitation of Liability

To the fullest extent permitted by law, Everest Wealth Builder LLC (Annapurna Insurance Solutions), its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or relating to the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid us for the Services during the 12 months before the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

17. Indemnification

You agree to defend, indemnify, and hold harmless Everest Wealth Builder LLC (Annapurna Insurance Solutions), its affiliates, officers, directors, employees, contractors, and licensors from and against claims, damages, liabilities, losses, costs, and expenses arising from your use of the Services, your content, your communications, your compliance obligations, or your violation of these Terms or applicable law.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in California, except where applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date on this page. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

20. Severability and Waiver

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms will not operate as a waiver of that provision or any other provision.
